Yet with yearly sales totaling only about a seventh of its Explorer SUV sibling, the Flex is not on the radar of many consumers looking for a three-row family hauler that seats six to seven. It's perplexing to us, because the 2015 Ford Flex is one of the most useful family vehicles out there. Reasons for our unabashed enthusiasm include the Flex's roomy and comfortable cabin complete with adult-friendly third-row seating, well-balanced ride and handling qualities and a wide array of options that include a strong turbocharged V6 engine. There's also the Flex's unique styling, which has a modern yet retro old-school wagon vibe about it. But even if you're not too keen on the rectilinear design aesthetic, there's no denying this Ford's inherent utility, versatility and abundance of useful high-tech gadgets. Seating up to seven with room to spare, the Ford Flex provides nearly as much passenger space and seating/cargo flexibility as a minivan but without the stigma. Getting into the Flex's second and third rows isn't as easy as with a minivan, but certainly access is better than in most large crossover SUVs thanks to the Flex's lower stance and standard second-row one-touch tumble feature. The optional second-row captain's chairs reduce seating capacity to six, but their sliding feature not only increases comfort in that row, but expands legroom in the third row. As such, the 2015 Ford Flex is the rare crossover that allows 6-footers to fit comfortably in all three rows. There are a couple of downsides to the Flex, however. The biggest of these is the aforementioned offbeat styling, which some people just find off-putting. If that's the case, the Ford Explorer is mechanically related and similarly equipped -- although, in the real world, it can't match the Flex's space and versatility. Outside of the Ford family, the GMC Acadia (and its siblings, the Buick Enclave and Chevrolet Traverse) has room for eight and a bigger cargo hold. We also like the Mazda CX-9 for its sporty personality and the Nissan Pathfinder for its upscale interior. Of course, a minivan would be more practical than any of these vehicles. Still, on our radar screen, the 2015 Ford Flex looms large as a top pick for savvy families. Body Styles, Trim Levels, and Options The 2015 Ford Flex is a large crossover/wagon available in six- or seven-passenger configurations. There are three trim levels: SE, SEL and Limited. The base SE comes standard with 17-inch alloy wheels, automatic headlights, rear privacy glass, rear parking sensors, cruise control, keypad entry, air-conditioning, a six-way power driver seat (manual recline and lumbar support), a leather-wrapped tilt-and-telescoping steering wheel, an auto-dimming rearview mirror, a 60/40-split second-row seat (with a passenger side auto-fold feature for easy access to the third row), a 4.2-inch central display screen, the base version of Sync (voice controls for phone and audio), Bluetooth phone and audio connectivity and a six-speaker sound system with a CD player, USB port and auxiliary audio jack. The SEL adds 18-inch wheels, heated mirrors, foglights, dual-zone automatic climate control, heated front seats, an eight-way power driver seat (with power lumbar), a six-way power front passenger seat and satellite radio. Also included is the MyFord Touch electronics interface, which includes an 8-inch central touchscreen, two multifunction secondary displays in the gauge cluster, enhanced steering-wheel controls, enhanced Ford Sync features (turn-by-turn navigation and traffic reports), two USB ports, an SD card reader and an audio/video input jack. Additional option packages are available for the SEL. Equipment Group 201A adds a 110-volt power outlet, a rearview camera and a power liftgate. Equipment Group 202A has those features plus a remote ignition, blind spot warning system, rear cross-traffic alerts, power-adjustable pedals, leather upholstery (vinyl in the third row), driver memory settings and an upgraded seven-speaker sound system. The Limited comes standard with the features from the SEL's 202A package and further adds 19-inch wheels, additional chrome/satin aluminum accents, xenon headlights, LED taillights, rain-sensing wipers, keyless ignition/entry, a navigation system and a 12-speaker Sony sound system with HD radio. Optional on every trim level are roof side rails, second-row inflatable seatbelts and sliding and reclining second-row captain's chairs with a center console. The navigation system is optional for the SEL. The Appearance package (SEL and Limited) adds 20-inch wheels, a black or color-matched painted roof, different exterior and interior trim and gray perforated leather upholstery inserts. The SEL and Limited can also be equipped with a multipanel rear sunroof (Vista Roof), a rear seat entertainment system (with dual displays) and a tow package. Stand-alone options for the Limited include 20-inch wheels, a refrigerated compartment in the optional second-row console, heated second-row captain's chairs and the Equipment Group 301A (or 303A) package that includes an automatic parallel-parking system, adaptive cruise control, a collision warning system with brake support, ventilated front seats, a power tilt-and-telescoping steering column and a one-touch power-fold-and-tumble third row. Powertrains and Performance Every 2015 Ford Flex comes standard with a 3.5-liter V6 that produces 287 horsepower and 254 pound-feet of torque. Front-wheel drive and a six-speed automatic transmission are standard. All-wheel drive is optional on the SEL and Limited. EPA-estimated fuel economy is 20 mpg combined (18 mpg city/25 mpg highway) with front-wheel drive. Opting for AWD lowers those estimates to 19 combined (17 city/23 highway). Optional on the Flex Limited is a turbocharged 3.5-liter V6 (dubbed EcoBoost) that produces 365 hp and 350 lb-ft of torque. This engine is paired exclusively with all-wheel drive and a six-speed automatic with steering-wheel-mounted paddle shifters. The last EcoBoost-equipped Flex we tested hit 60 mph in a swift 6.6 seconds. Fuel economy ratings drop to 18 combined (16 city/23 highway). Properly equipped, both powertrains are rated to tow up to 4,500 pounds. Safety The 2015 Ford Flex comes standard with antilock disc brakes, stability and traction control, front side airbags, side curtain airbags and rear parking sensors. The Ford Sync system includes an emergency crash notification feature that automatically dials 911 when paired with a compatible cell phone. Also standard is Ford's MyKey, which can be used to set certain parameters for teen drivers. A rearview camera and a blind spot warning system with rear cross-traffic alerts are optional on the SEL and standard for the Limited. Optional for both are second-row inflatable seatbelts. The Limited is also available with a collision warning system with brake support. In Insurance Institute for Highway Safety testing, the Flex earned a top rating of "Good" for its performance in moderate-overlap frontal-offset, side-impact and roof-strength tests. In Edmunds brake testing, both a Flex Limited with the standard 3.5-liter engine and an EcoBoost model stopped from 60 mph in 128 feet -- average for the class. Interior Design and Special Features Overall, we like the Flex's interior because of its abundant soft-touch materials and attractive, upscale design. The spacious layout comfortably affords seven-passenger seating rivaling that of a minivan. Even the third row is accessible and big enough for adults. The optional reclining and heated second-row captain's chairs reduce seating capacity to six, but comfort increases. Their ability to slide forward also expands third-row legroom. With either configuration, the standard auto-tumbling feature for the second row makes getting into the third row a snap. The Flex can hold a maximum of 83 cubic feet of stuff behind the first row. This is less voluminous than some minivans and several large crossovers, but you can make the most out of the available space thanks to the Flex's conveniently boxy shape. Unfortunately, both of the Flex's electronics interfaces leave something to be desired. The SE's MyFord system includes a display screen, but it's not especially intuitive and some buttons can be hard to reach. The MyFord Touch system that is standard on the SEL and Limited consists of configurable gauge cluster displays and a large main touchscreen. There are nice customization possibilities here, but the experience is soured by the touchscreen's virtual buttons that are slow to respond and prone to the occasional glitch. You'll likely acclimate to MyFord Touch and its idiosyncrasies (and the Sync voice command system continues to be very useful), but in general, other systems are easier to use. Driving Impressions The 2015 Ford Flex's base V6 is adequate for a vehicle this size, providing enough gusto to keep up with competing crossovers. The turbocharged V6, meanwhile, invigorates the Flex Limited with more of a sport wagon demeanor thanks to its extra power and the tighter suspension tuning that comes with it. No matter the model, the Flex provides a very pleasant, if not exactly exciting, driving experience. The ride is always comfortable -- even with the bigger wheels -- soaking up bumps in the road with luxury car ease. Uncharacteristically responsive steering adds to the Flex's well-rounded dynamics, as it makes parking easy and provides excellent stability on the open road. The waiver or invalidity of any provision of this Order shall not effect the binding nature of the remaining provisions. No breach of this Order by Buyer shall be deemed waived unless such waiver is agreed to by Seller in writing. The parties agree that any modification of this Order must be made in writing and signed by the parties in order to be valid. Buyer agrees that if the Vehicle is to be shipped, that shipping is Buyer’s responsibility. To the extent that Seller assists Buyer in arranging for shipping, such arrangements are made as a courtesy to Buyer and do not create any liability or responsibility on the part of Seller. Introduction The introduction of the Ford Explorer for 1991 helped cement the popularity of the sport-utility vehicle all across America. A rugged alternative to a station wagon, it was a perfect match for the times. Since then, the family SUV landscape has changed quite a bit, but the 2015 Ford Explorer has kept up with the times. Its combination of power, fuel economy and interior refinement makes it far more desirable for everyday use than previous versions. Like all modern crossover SUVs, the Ford Explorer has adopted carlike unibody construction in lieu of older models' truck-based underpinnings. The advantages are many, as today's Explorer offers more interior space, better fuel economy and a more comfortable ride, all of which are desirable in a family vehicle. The Ford is also pretty upscale inside, with seating for up to seven passengers and a comprehensive list of convenience and safety features. The latter includes advanced options you won't find on many other similarly priced crossover SUVs, such as second-row seatbelt airbags as well as lane-departure warning and lane-keeping assist. The standard 290-horsepower V6 will meet most buyers' needs, but the Explorer's turbocharged 2.0-liter four-cylinder engine is a viable option, too. It actually costs extra to get this engine, but we've found it's still suitably powerful and its fuel economy numbers are best-in-class. In theory, the fuel savings will also pay for the engine upgrade in just a few years. On the performance side of the spectrum, there's the Explorer Sport model, which comes with a turbocharged 3.5-liter V6 that generates 365 hp. In addition to that potent engine, the Sport also comes with firmer suspension tuning and special interior and exterior trim details. There are a few drawbacks to the 2015 Ford Explorer, depending on your priorities. Taller families may not be happy with the second- and third-row seating, which isn't as roomy as in other crossovers. It's the same with total cargo capacity. We're also not fond of the MyFord Touch interface's frequent glitches, or the way that the Explorer feels bigger behind the wheel than it really is -- even with all the available tech features onboard, it's not an easy vehicle to maneuver in tight spaces. As such, it's a good idea to shop around a bit. Possible alternatives include the roomier 2015 Chevrolet Traverse and 2015 Mazda CX-9; the refined 2015 Dodge Durango, which also gives you more versatility for towing; or even the Explorer's more wagonlike sibling, the Ford Flex. If you're drawn to the upscale look and many comforts of the 2015 Ford Explorer, however, it still stands as a respectable choice. No Video Content Body Styles, Trim Levels, and Options The 2015 Ford Explorer is a large crossover SUV available in base, XLT, Limited and Sport trim levels. Standard equipment includes a V6 engine, 17-inch steel wheels, automatic headlamps, rear privacy glass, integrated blind-spot mirrors, roof rails, cruise control, full power accessories, air-conditioning, a 50/50-split third-row seat, a six-way power driver seat (manual recline), a tilt-and-telescoping steering wheel, a trip computer and a six-speaker sound system with a CD player and an auxiliary audio jack. The XLT adds 18-inch alloy wheels, foglamps, rear parking sensors, a leather-wrapped steering wheel, a keyless entry code pad, Bluetooth, Sync (Ford's voice-activated phone/entertainment interface), a six-way front passenger seat, satellite radio and a USB port. With the XLT trim, Ford offers the Equipment Group 201A package that adds a rearview camera, dual-zone automatic climate control, a nine-speaker sound system and the Driver Connect package, which includes an auto-dimming rearview mirror, MyFord Touch electronics controls (includes three configurable displays, two USB ports, SD card reader and audio/video input jacks) and upgraded Sync functionality. The 202A package includes all of the 201A equipment, plus leather upholstery, heated front seats and an eight-way power driver seat with power-adjustable lumbar. The Limited bundles all of the above items and adds 20-inch wheels, heated outboard second-row seats, remote engine start, power-adjustable pedals with memory, a 110-volt power outlet and a 12-speaker Sony sound system with HD radio. Optional for the Limited is the 301A package, which includes a power liftgate, a power-folding operation for the third-row seat, an eight-way power passenger seat, ventilated front seats, a heated and power tilt-and-telescoping steering wheel and a navigation system. To this, the 302A package adds xenon headlamps, automatic high beams, an automatic parallel-parking system, lane-departure and lane-keeping assist, a blind-spot warning system and inflatable seatbelts for second-row outboard passengers. Adaptive cruise control with impeding frontal collision warning and brake priming is a stand-alone option. The Explorer Sport is equipped similarly to the Limited, although it lacks the leather upholstery, 110-volt outlet and power-adjustable pedals. It also comes with different 20-inch wheels, a sport-tuned suspension, front sport seats (with extra lateral bolstering) and unique interior and exterior trim details. The Sport's 401A package adds the power liftgate, navigation system, blind-spot monitoring, cross-traffic alert, inflatable seatbelts, power-adjustable steering wheel and pedals, heated and ventilated front seats, leather upholstery, driver seat memory, power front passenger seat and 110-volt outlet. The navigation system and adaptive cruise control can also be purchased as stand-alone options. Some of the features in the XLT and Limited's optional packages can be added as individual options, too. These include a dual-panel sunroof, second-row captain's chairs and a rear seat entertainment system with dual headrest-mounted displays. Powertrains and Performance All 2015 Ford Explorers, except for the Sport, come standard with a 3.5-liter V6 that produces 290 hp and 255 pound-feet of torque along with a six-speed automatic transmission. With this engine, you have your choice of front-wheel drive or optional four-wheel drive (there is no low-range gearing). Four-wheel-drive models have Ford's Terrain Management System, a selectable four-mode system that optimizes traction electronically for different conditions. Hill descent control and hill start assist are also included. In Edmunds testing, a 4WD Explorer Limited with the base V6 accelerated from zero to 60 mph in 8.4 seconds, while a lighter 4WD XLT model was slightly quicker at 8.1 seconds -- these are average times for a large crossover SUV. A front-drive V6 Explorer returns an EPA-estimated 17 mpg city/24 mpg highway and 20 mpg combined, also average for the class. Four-wheel drive lowers this to a still respectable 16/22/18. Optional on all front-wheel-drive Ford Explorers is the turbocharged 2.0-liter four-cylinder engine making 240 hp and 270 lb-ft of torque. It also uses the six-speed automatic transmission. In Edmunds testing, a four-cylinder-equipped Explorer went from zero to 60 mph in 9.1 seconds, which is on the slow side for the class. Fuel economy, however, is best-in-class at 20/28/23. The Explorer Sport is 4WD only, and it comes with a turbocharged 3.5-liter V6 engine and the six-speed automatic. The turbo V6 is rated at 365 hp and 360 lb-ft of torque. EPA-estimated fuel economy stands at 16 mpg city and 22 mpg highway. Properly equipped, an Explorer with either of the V6 engines can tow 5,000 pounds. Safety Every 2015 Ford Explorer comes standard with stability and traction control, trailer sway control, front seat side airbags, side curtain airbags, a front passenger knee airbag and MyKey, which allows parents to specify limits for vehicle speed and stereo volume. The Explorer's stability control system also includes Ford's Curve Control, which can monitor speed carried into a corner and decelerate if necessary. Rear parking sensors are standard on all but the base Explorer. A rearview camera is optional for the XLT and standard on the Limited. The Limited can also be had with impending frontal collision warning and brake priming (bundled with the adaptive cruise control), lane-departure warning and lane-keeping assist, a blind-spot warning system and inflatable seatbelts for second-row outboard passengers. In Edmunds brake testing, both the 4WD Explorer XLT and Limited V6 stopped from 60 mph in 118 feet -- a good performance for a large crossover SUV. Meanwhile, the four-cylinder Explorer XLT did it in 130 feet, which is just average for this class. In government crash tests, the Explorer earned a five-star rating (out of a possible five) for overall crash protection, with five stars for total front-impact protection and five stars for total side-impact protection. The Insurance Institute for Highway Safety similarly gave its top score of "Good" for the Explorer's performance in frontal-offset, side-impact and roof-strength tests. Its seatbelts and head restraints also earned a "Good" rating for whiplash protection in rear impacts. Interior Design and Special Features Especially considering the price, the Explorer's interior is pleasantly upscale. Materials quality is attractive and luxurious, with a soft-touch dashboard and precise-feeling controls. The front seats are very supportive, too. The optional MyFord Touch interface contributes to the premium vibe, as it adds a high-resolution display screen (plus two additional screens for the gauge cluster) and touch-sensitive audio and climate "buttons." We've never been very fond of this system, but in our tests of the 2015 Explorer, Ford's latest improvements to MyFord Touch have made a noticeable difference. While it's still not the easiest touchscreen interface to use, the previous glitches and slow response times have been banished. As before, we also like how MyFord Touch complements the voice-activated Sync system. The Explorer has 80 cubic feet of maximum cargo space, making it less spacious than the Dodge Durango and well below the Chevrolet Traverse and GMC Acadia. The third row is somewhat cramped and will only really work for children. Families with small children might also be disappointed with the Explorer's second-row seats, as there's not as much room to install rear-facing child safety seats -- something you'd expect to do with ease in a vehicle of this size. And while the Explorer has the commanding ride height expected in an SUV, its thick roof pillars and tall dash limit outward visibility. Even when you equip all the available parking aids, it's a handful in tight spaces. Driving Impressions The 2015 Ford Explorer rides very smoothly on the highway, with good composure that gets only a little busier with the Limited model's 20-inch wheels over broken pavement. As such, Ford's crossover SUV is enjoyable on longer drives. It handles securely in typical driving situations, but overall, it feels larger and less maneuverable than similarly sized rivals. The same is true of the Explorer Sport, but thanks to its sport-tuned suspension and steering, it reacts more quickly to inputs and generally imparts greater driver confidence. And while the Sport gives up a bit of that cushy ride quality, the ride is still well within the realm of acceptability for this class of vehicle. The Sport also comes with the turbocharged V6, which offers V8-like acceleration. But the reality is that the base V6 is powerful enough in most situations. And don't be quick to dismiss the idea of a four-cylinder powering this none-too-small SUV. The damage to the Vehicle may include damage that resulted in the Vehicle being deemed a total loss by an insurance company. The Vehicle's status as a total loss vehicle may or may not be reflected on the Vehicle's certificate of title and/or in the Vehicle's title history. Buyer does not rely on any statements from Seller relating to the severity of the accident or nature or quality of the repairs. Seller makes no representations or warranties relating in any way to the quality or nature of such repairs and whether such repairs could affect the safety or reliability of the Vehicle. Buyer's opportunity to inspect or to have the Vehicle inspected, as outlined above is specifically designed to allow Buyer to fully and completely assess the Vehicle prior to purchase. The purchase price for the Vehicle has been negotiated by the parties by taking into consideration the prior accident damage and the current condition of the Vehicle Seller makes no warranties, representation or assurances that the motor vehicle contains only original manufacturer installed or manufacturer rebuilt components, parts or accessories. In addition to other warranties made in this Order, Buyer expressly warrants the following: (a) To the extent that Buyer seeks financing for the Vehicle, Buyer warrants that all information contained on any credit application or other document submitted to Seller in order to obtain financing is true and accurate. Buyer acknowledges that the price of the vehicle is not effected by Buyer’s decision to finance the Vehicle or based upon the financial institution through which Buyer elects to finance the Vehicle. (b) To the extent that Buyer is trading in a vehicle (hereinafter “Trade”) as part of this transaction, Buyer agrees to provide satisfactory title to such Trade. Buyer warrants that the Trade is free and clear of all liens and encumbrances, other than those disclosed above. Buyer warrants that Buyer is the sole owner of the Trade and that Buyer has the right to assign title to the Trade to Seller. Buyer warrants that the Trade is in good operating condition and that it has not suffered accident or collision damage of which Buyer is aware. (c) Buyer warrants that Buyer has and will maintain full liability and comprehensive insurance coverage on the Vehicle.(d) Buyer warrants that this Order and any accompanying finance documents are complete and accurate at the time the Buyer signed them. (e) Buyer warrants that Buyer is over the age of 18, of sound mind, not under the influence of any drugs or alcohol and is otherwise competent to enter into this transaction. In addition to all other rights and remedies available to Seller at law or in equity, Seller has the following rights and remedies under this Order: (a) Reclamation. – Seller may enter into Buyer’s property and reclaim the Vehicle with or without notification to Buyer. Seller may also make a written demand on Seller to return the Vehicle and Buyer agrees to do so within 24 hours of such demand. (b) Disposition of Trade – Buyer agrees that immediately upon Buyer’s execution of this Order, Seller may dispose of Buyer’s Trade in any commercially reasonable manner, including the sale of the Trade to a third party, retail or wholesale. In the event that this Order is not completed for any reason or in the event that it is rescinded for any reason, Seller agrees that Buyer may retain the proceeds of the sale of the Trade to offset its damages, if any. If Seller does not have any damages relating to rescission or failure of this Order to be completed, Seller may retain any costs and reconditioning expenses relating to the sale plus a 15% commission on the sale from the sale proceeds. The remaining amount shall be delivered to Buyer in full satisfaction of any claims relating to the Trade. (c) In the event that Buyer pursues any claim for rescission of this transaction, Seller shall have the right to set off against Buyer’s damages or to assert as an independent claim, a claim for the reasonable value of Buyer’s use of the vehicle, including depreciation and mileage of the Vehicle. If any term of this Order is held to be unconscionable or unenforceable, for any reason, by any court of competent jurisdiction, this Order shall be construed as if such clause were never a part of this Order and the balance of the terms of this Order shall be binding on the parties. The waiver or invalidity of any provision of this Order shall not effect the binding nature of the remaining provisions. No breach of this Order by Buyer shall be deemed waived unless such waiver is agreed to by Seller in writing. The parties agree that any modification of this Order must be made in writing and signed by the parties in order to be valid. Buyer agrees that if the Vehicle is to be shipped, that shipping is Buyer’s responsibility. To the extent that Seller assists Buyer in arranging for shipping, such arrangements are made as a courtesy to Buyer and do not create any liability or responsibility on the part of Seller. Buyer agrees that all risk of loss transfers to Buyer upon delivery of the Vehicle to Buyer’s carrier and Buyer appoints such carrier as Buyer’s agent for purposes of accepting delivery of the Vehicle. Buyer agrees that Buyer’s deposit /down payment on the Vehicle is non-refundable, unless otherwise agreed to in writing by Buyer and Seller. Buyer agrees that the Vehicle has been delivered to Buyer and Buyer accepts delivery of the Vehicle in Florida, at Seller’s principle place of business. If Buyer is shipping the Vehicle out of state, then the person accepting delivery of the Vehicle for Buyer shall be deemed Buyer’s agent for accepting delivery of the Vehicle in Florida. This Order and the entire transaction between the parties shall be governed by Florida law. This Order supersedes any and all prior and contemporaneous verbal or written agreements, representations and/or understandings between Buyer and Seller. The terms, representations and conditions set forth in this Order, and any applicable financing agreement, constitute the entire agreement of the parties. Second-row heated seats are now standard on the Limited trim level. Introduction The introduction of the Ford Explorer for 1991 helped cement the popularity of the sport-utility vehicle all across America. A rugged alternative to a station wagon, it was a perfect match for the times. Since then, the family SUV landscape has changed quite a bit, but the 2015 Ford Explorer has kept up with the times. Its combination of power, fuel economy and interior refinement makes it far more desirable for everyday use than previous versions. Like all modern crossover SUVs, the Ford Explorer has adopted carlike unibody construction in lieu of older models' truck-based underpinnings. The advantages are many, as today's Explorer offers more interior space, better fuel economy and a more comfortable ride, all of which are desirable in a family vehicle. The Ford is also pretty upscale inside, with seating for up to seven passengers and a comprehensive list of convenience and safety features. The latter includes advanced options you won't find on many other similarly priced crossover SUVs, such as second-row seatbelt airbags as well as lane-departure warning and lane-keeping assist. The standard 290-horsepower V6 will meet most buyers' needs, but the Explorer's turbocharged 2.0-liter four-cylinder engine is a viable option, too. It actually costs extra to get this engine, but we've found it's still suitably powerful and its fuel economy numbers are best-in-class. In theory, the fuel savings will also pay for the engine upgrade in just a few years. On the performance side of the spectrum, there's the Explorer Sport model, which comes with a turbocharged 3.5-liter V6 that generates 365 hp. In addition to that potent engine, the Sport also comes with firmer suspension tuning and special interior and exterior trim details. There are a few drawbacks to the 2015 Ford Explorer, depending on your priorities. Taller families may not be happy with the second- and third-row seating, which isn't as roomy as in other crossovers. It's the same with total cargo capacity. We're also not fond of the MyFord Touch interface's frequent glitches, or the way that the Explorer feels bigger behind the wheel than it really is -- even with all the available tech features onboard, it's not an easy vehicle to maneuver in tight spaces. As such, it's a good idea to shop around a bit. Possible alternatives include the roomier 2015 Chevrolet Traverse and 2015 Mazda CX-9; the refined 2015 Dodge Durango, which also gives you more versatility for towing; or even the Explorer's more wagonlike sibling, the Ford Flex. If you're drawn to the upscale look and many comforts of the 2015 Ford Explorer, however, it still stands as a respectable choice. No Video Content Body Styles, Trim Levels, and Options The 2015 Ford Explorer is a large crossover SUV available in base, XLT, Limited and Sport trim levels. Standard equipment includes a V6 engine, 17-inch steel wheels, automatic headlamps, rear privacy glass, integrated blind-spot mirrors, roof rails, cruise control, full power accessories, air-conditioning, a 50/50-split third-row seat, a six-way power driver seat (manual recline), a tilt-and-telescoping steering wheel, a trip computer and a six-speaker sound system with a CD player and an auxiliary audio jack. The XLT adds 18-inch alloy wheels, foglamps, rear parking sensors, a leather-wrapped steering wheel, a keyless entry code pad, Bluetooth, Sync (Ford's voice-activated phone/entertainment interface), a six-way front passenger seat, satellite radio and a USB port. With the XLT trim, Ford offers the Equipment Group 201A package that adds a rearview camera, dual-zone automatic climate control, a nine-speaker sound system and the Driver Connect package, which includes an auto-dimming rearview mirror, MyFord Touch electronics controls (includes three configurable displays, two USB ports, SD card reader and audio/video input jacks) and upgraded Sync functionality. The 202A package includes all of the 201A equipment, plus leather upholstery, heated front seats and an eight-way power driver seat with power-adjustable lumbar. The Limited bundles all of the above items and adds 20-inch wheels, heated outboard second-row seats, remote engine start, power-adjustable pedals with memory, a 110-volt power outlet and a 12-speaker Sony sound system with HD radio. Optional for the Limited is the 301A package, which includes a power liftgate, a power-folding operation for the third-row seat, an eight-way power passenger seat, ventilated front seats, a heated and power tilt-and-telescoping steering wheel and a navigation system. To this, the 302A package adds xenon headlamps, automatic high beams, an automatic parallel-parking system, lane-departure and lane-keeping assist, a blind-spot warning system and inflatable seatbelts for second-row outboard passengers. Adaptive cruise control with impeding frontal collision warning and brake priming is a stand-alone option. The Explorer Sport is equipped similarly to the Limited, although it lacks the leather upholstery, 110-volt outlet and power-adjustable pedals. It also comes with different 20-inch wheels, a sport-tuned suspension, front sport seats (with extra lateral bolstering) and unique interior and exterior trim details. The Sport's 401A package adds the power liftgate, navigation system, blind-spot monitoring, cross-traffic alert, inflatable seatbelts, power-adjustable steering wheel and pedals, heated and ventilated front seats, leather upholstery, driver seat memory, power front passenger seat and 110-volt outlet. The navigation system and adaptive cruise control can also be purchased as stand-alone options. Some of the features in the XLT and Limited's optional packages can be added as individual options, too. These include a dual-panel sunroof, second-row captain's chairs and a rear seat entertainment system with dual headrest-mounted displays. Powertrains and Performance All 2015 Ford Explorers, except for the Sport, come standard with a 3.5-liter V6 that produces 290 hp and 255 pound-feet of torque along with a six-speed automatic transmission. With this engine, you have your choice of front-wheel drive or optional four-wheel drive (there is no low-range gearing). Four-wheel-drive models have Ford's Terrain Management System, a selectable four-mode system that optimizes traction electronically for different conditions. Hill descent control and hill start assist are also included. In Edmunds testing, a 4WD Explorer Limited with the base V6 accelerated from zero to 60 mph in 8.4 seconds, while a lighter 4WD XLT model was slightly quicker at 8.1 seconds -- these are average times for a large crossover SUV. A front-drive V6 Explorer returns an EPA-estimated 17 mpg city/24 mpg highway and 20 mpg combined, also average for the class. Four-wheel drive lowers this to a still respectable 16/22/18. Optional on all front-wheel-drive Ford Explorers is the turbocharged 2.0-liter four-cylinder engine making 240 hp and 270 lb-ft of torque. It also uses the six-speed automatic transmission. In Edmunds testing, a four-cylinder-equipped Explorer went from zero to 60 mph in 9.1 seconds, which is on the slow side for the class. Fuel economy, however, is best-in-class at 20/28/23. The Explorer Sport is 4WD only, and it comes with a turbocharged 3.5-liter V6 engine and the six-speed automatic. The turbo V6 is rated at 365 hp and 360 lb-ft of torque. EPA-estimated fuel economy stands at 16 mpg city and 22 mpg highway. Properly equipped, an Explorer with either of the V6 engines can tow 5,000 pounds. Safety Every 2015 Ford Explorer comes standard with stability and traction control, trailer sway control, front seat side airbags, side curtain airbags, a front passenger knee airbag and MyKey, which allows parents to specify limits for vehicle speed and stereo volume. The Explorer's stability control system also includes Ford's Curve Control, which can monitor speed carried into a corner and decelerate if necessary. Rear parking sensors are standard on all but the base Explorer. A rearview camera is optional for the XLT and standard on the Limited. The Limited can also be had with impending frontal collision warning and brake priming (bundled with the adaptive cruise control), lane-departure warning and lane-keeping assist, a blind-spot warning system and inflatable seatbelts for second-row outboard passengers. In Edmunds brake testing, both the 4WD Explorer XLT and Limited V6 stopped from 60 mph in 118 feet -- a good performance for a large crossover SUV. Meanwhile, the four-cylinder Explorer XLT did it in 130 feet, which is just average for this class. In government crash tests, the Explorer earned a five-star rating (out of a possible five) for overall crash protection, with five stars for total front-impact protection and five stars for total side-impact protection. The Insurance Institute for Highway Safety similarly gave its top score of "Good" for the Explorer's performance in frontal-offset, side-impact and roof-strength tests. Its seatbelts and head restraints also earned a "Good" rating for whiplash protection in rear impacts. Interior Design and Special Features Especially considering the price, the Explorer's interior is pleasantly upscale. Materials quality is attractive and luxurious, with a soft-touch dashboard and precise-feeling controls. The front seats are very supportive, too. The optional MyFord Touch interface contributes to the premium vibe, as it adds a high-resolution display screen (plus two additional screens for the gauge cluster) and touch-sensitive audio and climate "buttons." We've never been very fond of this system, but in our tests of the 2015 Explorer, Ford's latest improvements to MyFord Touch have made a noticeable difference. While it's still not the easiest touchscreen interface to use, the previous glitches and slow response times have been banished. As before, we also like how MyFord Touch complements the voice-activated Sync system. The Explorer has 80 cubic feet of maximum cargo space, making it less spacious than the Dodge Durango and well below the Chevrolet Traverse and GMC Acadia. The third row is somewhat cramped and will only really work for children. Families with small children might also be disappointed with the Explorer's second-row seats, as there's not as much room to install rear-facing child safety seats -- something you'd expect to do with ease in a vehicle of this size. And while the Explorer has the commanding ride height expected in an SUV, its thick roof pillars and tall dash limit outward visibility. Even when you equip all the available parking aids, it's a handful in tight spaces. Driving Impressions The 2015 Ford Explorer rides very smoothly on the highway, with good composure that gets only a little busier with the Limited model's 20-inch wheels over broken pavement. As such, Ford's crossover SUV is enjoyable on longer drives. It handles securely in typical driving situations, but overall, it feels larger and less maneuverable than similarly sized rivals. The same is true of the Explorer Sport, but thanks to its sport-tuned suspension and steering, it reacts more quickly to inputs and generally imparts greater driver confidence. And while the Sport gives up a bit of that cushy ride quality, the ride is still well within the realm of acceptability for this class of vehicle. The Sport also comes with the turbocharged V6, which offers V8-like acceleration. But the reality is that the base V6 is powerful enough in most situations. And don't be quick to dismiss the idea of a four-cylinder powering this none-too-small SUV. Introduction The 2014 Ford E-Series Van makes a case for automotive natural selection. As new vehicles emerge, this dinosaur of a van balances on the edge of extinction. This year marks the last time you'll be able to choose from the full traditional Econoline lineup, as a new full-size Ford Transit van is poised to replace it. There is a distinct possibility, however, that a variant of the E-Series will remain in production for pure commercial use. Compared to pretty much any vehicle on sale today, the E-Series, or Econoline, vans are lumbering throwbacks that have fallen woefully behind the times. The E-Series Van represents a model that is geared more toward cargo hauling, as opposed to the E-Series Wagon, which is intended more for passengers. As such, the interior of the base E-Series may remind you of the inside of a tin shack rather than any other modern vehicle. Under the abbreviated hood, the outdated theme continues. The base 4.6-liter V8 engine seems barely capable of moving this behemoth and the ride quality is notably crude by SUV standards. Not much can be done to improve ride comfort, but there are at least more powerful engines available. In the 2014 Ford E-Series Van's defense, the Chevrolet Express Cargo and its GMC Savana twin are just as behind the times. In light of this, we suggest checking out the 2014 Nissan NV, which can be specified with a tall roof option. The Mercedes-Benz Sprinter also offers roof options, as well as a driver-side sliding door and diesel engine. No Video Content Body Styles, Trim Levels, and Options Classified as a full-size van, the 2014 Ford E-Series Van is offered in three variants. Shoppers with lighter-capacity needs can start with the E-150 model, while those with more demanding requirements should focus on the e-150 and E-350 Super Duty models. These heavier-duty vehicles come in two different lengths -- 212 inches for the regular version and 232 inches for the Extended model. Intended as a commercial workhorse, the E-Series Van is short on creature comforts. Standard features are limited to 16-inch steel wheels, a limited-slip differential, vinyl front bucket seats, vinyl front floor coverings, air-conditioning, a tilt-only steering wheel, manual telescoping mirrors and a two-speaker AM/FM radio with an auxiliary audio jack. Available options include alloy wheels, chrome exterior trim, power-adjustable and manually telescoping mirrors, running boards, a sliding side door, rear parking sensors, upgraded towing packages with optimized axle ratios, a household power outlet, a second-row bench seat, interior insulation, cloth upholstery, captain's chairs, cruise control, keyless entry, a navigation system, Ford's Sync voice activation system, user-defined upfitter switches, a rearview camera, satellite radio and a six-speaker CD stereo. For the business on wheels that demands additional customization, there are several special packages that equip the E-Series with a variety of racks, bins and drawers, as well as the optional Crew Chief and Ford Work Solutions. Crew Chief keeps tabs on vans in its fleet, tracking location, speed, idle time and maintenance, while Work Solutions turns the E-Series into an office on wheels, with a built-in computer, mobile Internet, remote file access and even on-site tool inventory. Powertrains and Performance The 2014 E-Series Van has three engines from which to choose. Standard on the E-150 is a 4.6-liter V8 that produces 225 horsepower and 286 pound-feet of torque. Optional on the E-150 and standard on all E-350 models is a 5.4-liter V8 that makes 255 hp and 350 lb-ft of torque. Both engines are paired with a four-speed automatic transmission. E-350 buyers can upgrade to a 6.8-liter V10 that churns out 305 hp and 420 lb-ft of torque. A five-speed automatic comes with the V10. Properly equipped, an E-350 can tow up to 10,000 pounds. Fuel estimates vary depending on axle ratios. The 4.6-liter V8 turns in an EPA-estimated 13 mpg city/17 mpg highway and 15 mpg in combined driving. The 5.4-liter engine is rated at 12/16/14 mpg for the E-150 and 12/16/13 mpg for the E-350. The 6.8-liter V10 is estimated at 10/14/12 mpg. Safety All 2014 Ford E-Series Vans come standard with four-wheel antilock disc brakes and stability control. Side or side curtain airbags are not available, but a rearview camera and rear parking sensors are available as options. Interior Design and Special Features Inside the 2014 Ford E-Series vans, function definitely takes priority over form. The cabin is decidedly spartan with its vinyl flooring and upholstery but can be made a bit more civilized with the addition of an optional second-row bench, front captain's chairs, an insulation package, side or rear window glass and/or a sliding side cargo door. Pleasing shapes and creature comforts are nearly absent, too, with blocky, industrial shapes dominating the cabin and padded surfaces also at a premium. Fortunately, controls are well placed and storage is plentiful. Unlike in the Sprinter, there is no optional driver-side sliding door, nor are there different roof heights as with the Sprinter and Nissan NV. Standard-length vans have a maximum cargo capacity of 237 cubic feet, while extended-length vans check in with a voluminous 275 cubic feet of space. Driving Impressions The base 4.6-liter V8 seems ill-suited for such a utilitarian and brawny hauler as the 2014 Ford E-Series Van. It is just barely sufficient for motivating light loads, and acceleration is lethargic at best. Either of the more powerful engines will likely satisfy most drivers, but we still wish Ford offered a diesel option. The big van drives just about how you'd expect. The turning circle is enormous and any change in direction is accompanied by a sizable amount of body roll. Those used to a carlike ride will probably find the E-Series a bit crude but forgivable, given its considerable utility. Full Expert Review: 2015 Ford Expedition No Video Content What's New for 2015 The 2015 Ford Expedition has been updated with a new engine, new suspension options, subtle styling changes and an improved interior. Introduction While there are many crossover SUVs available today with impressive mileage, roomy interiors and respectable cargo space, some families need something even bigger. That's where full-size, traditional SUVs like the 2015 Ford Expedition come in, providing three rows of seating, heavy-duty towing capacity and enough space for even the largest brood. The 2015 Expedition looks a little more modern this year, thanks to new front and rear styling, but the biggest change is under the hood. In a move toward better fuel economy, Ford has dropped the V8 engine. It's not even an option. Instead, every 2015 Expedition gets a turbocharged V6 that provides 365 horsepower and 420 pound-feet of torque, which is even better than the previous V8. Ford has also updated the Expedition's suspension. It's now available with adjustable damping that has three selectable drive modes: Comfort, Normal and Sport. In such a large vehicle that was already pretty comfortable, this is an added benefit that makes traveling in the Expedition that much more appealing. When it comes to carrying a large group of people and/or towing a boat or trailer, the 2015 Expedition is still one of the few vehicles that can handle almost anything you throw at it. It can tow up to 9,200 pounds when properly equipped and offers seating for up to eight people. The 2015 Expedition's interior has a fresher and more modern look, which incorporates the latest MyFord Touch infotainment interface. For cargo of all kinds, it's one of the roomiest vehicles on the road, too, with more than 130 cubic feet of cargo space available in the Expedition EL version when you fold down the second and third rows of seats. It's not surprising, then, that a major drawback to owning an Expedition is its sheer size. To assuage parking issues, there are rear parking sensors and a rearview camera equipped as standard, but somehow the Expedition still feels hard to handle and even bigger than it is. Not everyone will need the Expedition's hulking size, though, so we recommend looking at some smaller competitors if you aren't constantly hauling seven other people and their gear. We also recommend looking at the redesigned 2015 Chevrolet Tahoe and 2015 Chevrolet Suburban (and their GMC Yukon twins), which will seat up to nine passengers and still provide a V8 powertrain. The Toyota Sequoia should also be considered, as it will also seat eight passengers, while feeling a bit lighter on its feet. The bottom line is, if you're interested in one of these traditional SUVs, it's because you need the capability they provide, and the 2015 Ford Expedition is clearly a top contender. No Video Content Body Styles, Trim Levels, and Options The 2015 Ford Expedition is a full-size, traditional body-on-frame SUV available in two body styles: the regular Expedition and the extended-wheelbase Expedition EL, which is 15 inches longer overall. Both are offered in four trim levels: XLT, Limited, King Ranch and the new Platinum trim (XL models are sold only to fleet customers). Every Expedition comes standard with seating for eight passengers, and optional second-row captain's chairs reduce that capacity to seven. The XLT comes standard with 18-inch alloy wheels, automatic headlights, foglights, running boards, a roof rack, rear parking sensors, heated mirrors, power rear quarter windows and keyless entry (both remote and door-mounted keypad). Inside you'll find cruise control, a 4.2-inch center display, a rearview camera, air-conditioning, a six-way power driver seat (manual recline), power-adjustable pedals, a sliding and reclining 40/20/40-split second-row seat, a fold-flat third-row seat, a leather-wrapped tilt-and-telescoping steering wheel, an auto-dimming rearview mirror, Ford's voice-operated Sync system, Bluetooth phone and audio connectivity and a six-speaker sound system with a CD player, satellite radio, an iPod/USB audio interface, an auxiliary audio jack and rear audio controls. The XLT 201A package adds a power liftgate, heated rearview mirrors, leather upholstery (for the first- and second-row seats; the third row has vinyl), an eight-way power driver seat (with power lumbar), a six-way front passenger seat and a power-folding third-row seat. The 202A package gets those items plus a heavy-duty trailer tow package, remote ignition, dual-zone automatic climate control, a 110-volt household-style power outlet, heated and ventilated front seats, driver memory settings, a power tilt-and-telescoping steering wheel, an eight-way power passenger seat (with power lumbar), the MyFord Touch interface with an 8-inch touchscreen and an upgraded 12-speaker Sony audio system with satellite radio. The Limited trim includes all of the above items along with 20-inch wheels, front parking sensors, power-folding mirrors (with a driver-side auto-dimming mirror), automatic wipers and heated second-row seats. The 301A Package adds a sunroof, retractable running boards and a navigation system with HD radio. The Western-chic King Ranch Edition is equipped similarly to the Limited, but has special two-tone paint, special exterior styling details, a blind-spot monitoring system, premium leather upholstery and wood grain interior trim. The Platinum is similarly equipped to the King Ranch, but it loses the Western theme and gets the sunroof as standard. Other stand-alone options for the Expedition, depending on the trim level, include a load-leveling rear suspension, 22-inch wheels, adaptive suspension dampers, second-row captain's chairs and a dual-screen rear seat video entertainment system. Powertrains and Performance Powering the 2015 Ford Expedition and Expedition EL is a turbocharged 3.5-liter V6 making 365 hp and 420 lb-ft of torque. Mated to a six-speed automatic transmission with manual-shift capability, rear-wheel drive is standard, but buyers can opt for four-wheel drive with low-range gearing. Properly equipped, the Expedition has a maximum tow rating of 9,200 pounds. The EPA estimates a standard 2WD Expedition will earn 18 mpg combined (16 city/22 highway), with the extended-wheelbase EL model coming in at 17 mpg combined (15/21). Opting for a 4WD Expedition drops those estimates only slightly. On a highway-biased evaluation loop of our own, we exactly matched the EPA's 17 mpg combined estimate in a 2015 Expedition with 4WD. At the Edmunds test track, that same Expedition Platinum 4x4 proved to be one of the quickest trucks in its class, as it made the dash to 60 mph in just 6.5 seconds, easily trouncing competitive full-size SUVs equipped with traditional V8 engines. Safety The Ford Expedition comes standard with antilock disc brakes, stability and traction control, trailer sway control, front-seat side airbags and full-length side curtain airbags. At the Edmunds test facility, a 2015 Expedition 4x4 came to a controlled stop from 60 mph in 126 feet, an average distance for its class. Ford's programmable MyKey system, which allows parents to specify maximum speed limits and stereo volumes for secondary drivers, is also standard. Rear parking sensors and a rearview camera are also standard across the board, and the Limited and King Ranch also have front sensors. A blind-spot monitoring system is standard on the King Ranch and Platinum trim levels and optional for the others. Interior Design and Special Features Inside the 2015 Ford Expedition, you'll find plenty of room and a conservative but attractive look. Limited, King Ranch and the new Platinum models are especially classy, but there are a few low-quality surfaces that don't fit the upscale cabin theme. This year's Expedition finally gets the MyFord Touch interface as an option. Backed by many redundant voice commands, it can be a powerful tool for configuring and controlling the vehicle and your smartphone. Even though the system works significantly better than when it debuted, there can be a steep learning curve for getting accustomed to even basic functions. With a cabin this size, everyone -- even third-row occupants -- has a good amount of room to stretch out. The standard 40/20/40-split second-row seat both slides and reclines for greater comfort, and includes a center section that can be scooted forward to put small kids within reach of mom or dad. The available second-row captain's chairs are a small luxury, even though they drop seating capacity to seven passengers. The third-row seat also folds flat into the floor when you need more cargo room, useful for any family going on a luggage-heavy vacation. Speaking of cargo room, there's no shortage of it here. The standard Expedition offers 18.6 cubic feet behind the third row, while the Expedition EL sports 42.6 cubic feet. Fold down both rows of rear seats and you get a flat load floor with 108.3 cubic feet in the regular-size Expedition and 130.8 cubic feet in the Ford Expedition EL. For comparison, that's about 10 cubic feet more than the Sequoia and Suburban. Driving Impressions Although the 2015 Ford Expedition is a sizable beast, its four-wheel independent suspension gives it exceptionally smooth ride qualities for a traditional full-size SUV. This cannot be said of similarly sized SUVs with so-called live-axle rear suspensions. Opting for the Expedition's three-way adaptive dampers makes its excellent manners even better. Precise and responsive steering also contributes to its easy-to-drive nature, but its considerable dimensions are a notable limitation when trying to negotiate tight spaces. In relation to the V8 it replaced, the new turbocharged V6 engine's increase in horsepower is less noticeable than the thoroughly enhanced torque character. The turbocharger lights quickly, and the immediate shove it produces will convert even the most stubborn critic bemoaning the loss of the V8. Buyer acknowledges that the Vehicle being purchased was acquired by Seller through trade, a public or private sale or at an auction under circumstances in which the prior owner’s registration and/or use of the Vehicle may not have been disclosed to Seller. Even if not designated on this Order, Buyer acknowledges that the Vehicle being purchased may have been titled, registered or used as a (a) short term lease vehicle, (b) taxicab; or (c) police vehicle. In addition, the Vehicle may be (a) rebuilt, assembled from parts, or combined; (b) a kit car, glider kit, replica vehicle; (c) a flood vehicle;(d)a not actual mileage vehicle and/or (f) a non-conforming vehicle as that term is defined under Chapter 681 of the Florida Statutes. It is Buyer’s sole obligation to independently verify the Vehicle’s prior use or designation prior to purchase, if these items are material to Buyer. Buyer expressly acknowledges that the Vehicle being purchased under this Order has been involved in a prior accident and that it has sustained damage as a result of such accident. The damage to the Vehicle may include damage that resulted in the Vehicle being deemed a total loss by an insurance company. The Vehicle's status as a total loss vehicle may or may not be reflected on the Vehicle's certificate of title and/or in the Vehicle's title history. Buyer does not rely on any statements from Seller relating to the severity of the accident or nature or quality of the repairs. Seller makes no representations or warranties relating in any way to the quality or nature of such repairs and whether such repairs could affect the safety or reliability of the Vehicle. Buyer's opportunity to inspect or to have the Vehicle inspected, as outlined above is specifically designed to allow Buyer to fully and completely assess the Vehicle prior to purchase. The purchase price for the Vehicle has been negotiated by the parties by taking into consideration the prior accident damage and the current condition of the Vehicle Seller makes no warranties, representation or assurances that the motor vehicle contains only original manufacturer installed or manufacturer rebuilt components, parts or accessories. In addition to other warranties made in this Order, Buyer expressly warrants the following: (a) To the extent that Buyer seeks financing for the Vehicle, Buyer warrants that all information contained on any credit application or other document submitted to Seller in order to obtain financing is true and accurate. Buyer acknowledges that the price of the vehicle is not effected by Buyer’s decision to finance the Vehicle or based upon the financial institution through which Buyer elects to finance the Vehicle. (b) To the extent that Buyer is trading in a vehicle (hereinafter “Trade”) as part of this transaction, Buyer agrees to provide satisfactory title to such Trade. Buyer warrants that the Trade is free and clear of all liens and encumbrances, other than those disclosed above. Buyer warrants that Buyer is the sole owner of the Trade and that Buyer has the right to assign title to the Trade to Seller. Buyer warrants that the Trade is in good operating condition and that it has not suffered accident or collision damage of which Buyer is aware. (c) Buyer warrants that Buyer has and will maintain full liability and comprehensive insurance coverage on the Vehicle.(d) Buyer warrants that this Order and any accompanying finance documents are complete and accurate at the time the Buyer signed them. (e) Buyer warrants that Buyer is over the age of 18, of sound mind, not under the influence of any drugs or alcohol and is otherwise competent to enter into this transaction. In addition to all other rights and remedies available to Seller at law or in equity, Seller has the following rights and remedies under this Order: (a) Reclamation. – Seller may enter into Buyer’s property and reclaim the Vehicle with or without notification to Buyer. Seller may also make a written demand on Seller to return the Vehicle and Buyer agrees to do so within 24 hours of such demand. (b) Disposition of Trade – Buyer agrees that immediately upon Buyer’s execution of this Order, Seller may dispose of Buyer’s Trade in any commercially reasonable manner, including the sale of the Trade to a third party, retail or wholesale. In the event that this Order is not completed for any reason or in the event that it is rescinded for any reason, Seller agrees that Buyer may retain the proceeds of the sale of the Trade to offset its damages, if any. If Seller does not have any damages relating to rescission or failure of this Order to be completed, Seller may retain any costs and reconditioning expenses relating to the sale plus a 15% commission on the sale from the sale proceeds. The remaining amount shall be delivered to Buyer in full satisfaction of any claims relating to the Trade. (c) In the event that Buyer pursues any claim for rescission of this transaction, Seller shall have the right to set off against Buyer’s damages or to assert as an independent claim, a claim for the reasonable value of Buyer’s use of the vehicle, including depreciation and mileage of the Vehicle. If any term of this Order is held to be unconscionable or unenforceable, for any reason, by any court of competent jurisdiction, this Order shall be construed as if such clause were never a part of this Order and the balance of the terms of this Order shall be binding on the parties. The waiver or invalidity of any provision of this Order shall not effect the binding nature of the remaining provisions. No breach of this Order by Buyer shall be deemed waived unless such waiver is agreed to by Seller in writing. The parties agree that any modification of this Order must be made in writing and signed by the parties in order to be valid. Buyer agrees that if the Vehicle is to be shipped, that shipping is Buyer’s responsibility. To the extent that Seller assists Buyer in arranging for shipping, such arrangements are made as a courtesy to Buyer and do not create any liability or responsibility on the part of Seller. Buyer agrees that all risk of loss transfers to Buyer upon delivery of the Vehicle to Buyer’s carrier and Buyer appoints such carrier as Buyer’s agent for purposes of accepting delivery of the Vehicle. Buyer agrees that Buyer’s deposit /down payment on the Vehicle is non-refundable, unless otherwise agreed to in writing by Buyer and Seller. Buyer agrees that the Vehicle has been delivered to Buyer and Buyer accepts delivery of the Vehicle in Florida, at Seller’s principle place of business. If Buyer is shipping the Vehicle out of state, then the person accepting delivery of the Vehicle for Buyer shall be deemed Buyer’s agent for accepting delivery of the Vehicle in Florida. This Order and the entire transaction between the parties shall be governed by Florida law. This Order supersedes any and all prior and contemporaneous verbal or written agreements, representations and/or understandings between Buyer and Seller. The terms, representations and conditions set forth in this Order, and any applicable financing agreement, constitute the entire agreement of the parties. The parties to this Arbitration Agreement hereby agree that any and all Claims (defined below) shall be decided through binding arbitration as provided for herein. For purposes of this Arbitration Agreement: Us/Our means Diamond Financial Enterprise, Inc. d/b/a USA CARS and/or "Seller" (as identified in any accompanying Retail Installment Sales Contract), as well as their individual and/or collective parents, subsidiaries, affiliates, predecessors and successors in interest, and agents, and all of their officers, directors and employees. For purposes of this Arbitration Agreement Claim has the broadest possible meaning. It includes claims of every kind and nature regardless of who initiates it. This Arbitration Agreement requires that all Claims be arbitrated before an arbitrator instead of litigated in court with a Judge and/or a jury. The Claim shall be arbitrated on an individual basis and not as a class action. This Agreement applies to all Claims, even Claims that existed before you sign it. All Claims shall be resolved by arbitration in accordance with this Agreement. This Agreement survives payment of all You owe under any related Retail Installment Sales Contract or financing agreement and this Agreement remains binding upon the You and US even if the Retial Installment Sales Contract or financing agreement is assigned to a third party. If a court or arbitrator deems any part of this Arbitration Agreement invalid or unenforceable for any reason, the invalid or unenforceable provision shall drop out of the Arbitration Agreement and the remaining parts of this Arbitration Agreement shall be enforceable despite such invalidity.
