Introduction When the Scion brand debuted in 2002, its mission was to appeal to young buyers with stylish cars boasting affordable pricing, abundant customization options and the promise of reliability backed up by the reputation of Toyota, its parent company. Largely missing from that mix, however, has been performance. Now, a decade later, all the right elements have been combined for the all-new 2013 Scion FR-S. Co-developed with Subaru (which makes the twin of the FR-S, the Subaru BRZ), the FR-S ups the performance ante considerably above the Scion tC, the next sportiest car in the Scion family. The FR-S is powered by a 2.0-liter flat-4 ("boxer") engine that sends 200 horsepower to the rear wheels through either a six-speed manual or a six-speed automatic transmission. That's not a lot of power for a sporty car nowadays, and suitably, acceleration is merely acceptable. Yet, the FR-S's light weight, compact dimensions, low center of gravity, sublime steering and beautifully balanced chassis add up to enough fun that you won't mind when a Mustang V6 pulls away from you at a traffic light. The FR-S cockpit is all business. Frivolous gee-whiz features -- such as Scion's typical flashy instrument displays and adjustable mood lighting -- are nowhere to be found. Instead, the driver faces an array of instruments dominated by a large tachometer, while both front occupants are held fast by aggressively bolstered sport seats. Of course, don't expect a large measure of multipurpose practicality from the compact coupe, as the rear seat and trunk are diminutive. In terms of competition, the 2013 Scion FR-S has no direct rivals other than its Subaru twin. After all, affordable rear-wheel-drive sport coupes are few and far between. The Mazda MX-5 Miata is the closest in character to the FR-S, but if you prefer a rear-wheel-drive coupe, you'll have to step up to the more expensive Ford Mustang or Hyundai Genesis Coupe. Yet given its desirable qualities -- light weight and a responsive nature -- the 2013 Scion FR-S should be a thrill for driving enthusiasts looking for big kicks for small bucks. Body Styles, Trim Levels, and Options The 2013 Scion FR-S comes in two trim levels: base and 10 Series. Standard equipment includes 17-inch alloy wheels, air-conditioning, full power accessories, a height-adjustable driver seat, a tilt-and-telescoping leather-wrapped steering wheel, cruise control, Bluetooth (with streaming audio) and a Pioneer eight-speaker sound system with a CD player, HD radio, RCA output jacks, an auxiliary audio jack and USB/iPod integration. The 10 Series further adds xenon headlights, front LED running lights, illuminated exterior badges, dual-zone automatic climate control, a frameless rearview mirror, an electroluminescent dashboard (it lights up with the word "Scion" when a door is opened), a 6.1-inch touchscreen sound system display and a solar-powered illuminated shift knob (automatic transmission only). In keeping with Scion's marketing philosophy, in lieu of factory options there are a number of dealer-installed accessories that include foglights, a premium BeSpoke sound system (with touchscreen display and smartphone app integration) and various suspension and engine performance parts. Powertrains and Performance Under the FR-S's sleek hood is a 2.0-liter horizontally opposed "boxer" four-cylinder engine that makes 200 hp and 151 pound-feet of torque. Power is sent to the rear wheels through either a six-speed manual transmission or a six-speed automatic with paddle shifters and rev-matched downshifts. A traction-enhancing mechanical limited-slip differential is standard and rather rare in this segment. At the test track, a manual-equipped FR-S sprinted to 60 mph from a standstill in 6.5 seconds: fairly quick, if not as speedy as more powerful but heavier sport coupes. Testing of an automatic-equipped BRZ yielded a slower time of 7.9 seconds. Fuel economy estimates are quite good and stand at 22 mpg city/30 mpg highway and 25 mpg combined for the manual and 25/34/28 for the automatic. Safety Standard safety features include antilock brakes (with brake assist), traction and stability control, front-seat side airbags and full-length side curtain airbags. In Edmunds brake testing, the 2013 Scion FR-S came to a stop from 60 mph in 117 feet -- a short distance, though it's lower than average for a car with summer tires. In crash testing by the Insurance Institute for Highway Safety the FR-S received the highest possible rating of "Good" in the frontal-offset, side and roof strength tests. Interior Design and Special Features Scion has made few concessions to style for the FR-S's simple, businesslike cabin that blends Toyota and Subaru switchgear and materials. It's an environment that puts an emphasis on driving. Frankly, it will feel a bit spartan compared to some other sporty cars in its price range like the VW GTI, but then this is supposed to be a back-to-basics sort of driver's car. In true Scion form, the base audio system is anything but basic, however, as it comes with a full assortment of media types and controls. It's also much easier to use than the frustrating touchscreen unit found in its Subaru BRZ twin, although Scion does not offer the Subie's navigation system and some other features. The FR-S's front seats are supportive enough for hard driving, yet still comfortable for long-distance trips as well. People of just about any size should find the driving position to be quite agreeable, and thanks to the low-profile hood, there's an expansive view of the road ahead. There's a backseat, too, but few humans are likely to want to sit back there. Legroom is next to nil, your head will be perilously close to the rear glass (or entirely pressed against it) and the center tunnel impedes hiproom. Trunk space is also rather small at 6.9 cubic feet, but folding down that mostly useless backseat expands cargo-carrying abilities considerably. Driving Impressions If you're the sort of driver whose car must be able to hammer down freeway on-ramps with its tires ablaze, the 2013 Scion FR-S is not for you. Its power is sufficient and nothing more. Instead, the FR-S is for those who get a thrill from going around corners and feeling all the nuances and inputs that go along with a car that offers phenomenal communication and impeccable control. Its limits are approachable and easily controlled, which makes for a wonderfully engaging sports car. The brakes don't fade, the manual gearbox is a pleasure to shift and the chassis remains composed even when the road surface doesn't. The steering imparts the front tires' grip status precisely to the driver's hands, and even the available automatic transmission is programmed for enthusiastic driving. Away from twisty roads and used for more mundane moments -- say, on the way to work or on a road trip -- this Scion is still rewarding. There is also some damage to the driver side door area. We tried to get photos of all the damaged areas on the Hummer but we can only upload so many photos to eBay. The rear axle did have some various parts that were tweaked in the accident as well. Other than the cosmetic damage and the rear axle damage, the Hummer is in great mechanical shape and has a beautiful interior. None of the airbags were deployed in the accident. The vehicle does run fine and lot drives as well. The Hummer is being sold "AS IS" on an IOWA "prior salvaged" TITLE. Some states call this a "Rebuilt" title rather than "prior salvage". The base Sport convertible now gets a cloth folding top rather than vinyl. Introduction The 2015 Mazda Miata has stood the test of time. While other small, affordable roadsters have come and gone, the Miata is still going strong. To commemorate the car's 25th anniversary, Mazda has introduced a special-edition car loaded with all the options. But even in base form, there is still a lot to love about the Miata. Through the years, Mazda hasn't forgotten about the MX-5's primary mission: It is still a fantastic driver's car. It feels connected to the road thanks to a light, well-balanced chassis and plenty of steering feel. The Miata isn't all that powerful, but it is exceedingly fun to drive quickly, especially when you string together a series of corners. And thanks to the available retractable hardtop, the Miata is relatively comfortable and livable for daily commutes as well. Of course, when you get a small two-seat roadster, practicality suffers, and that's the Miata's biggest drawback. If you're tall, getting comfortable inside could be a struggle. Long vacations may be difficult, too, as the trunk is laughably small and you'll have a hard time fitting anything more than a few small bags. Don't expect too many creature comforts on the inside, either. Even in Grand Touring trim, the Edmunds.com "B" rated Miata's interior is nothing special to look at and hard plastic surfaces are plentiful. Bluetooth is only available on the higher trim levels, and items like a USB input and navigation system aren't available at all. On the other hand, some buyers may appreciate the simplicity of this cockpit, and of course, some of these issues will be addressed in the redesigned 2016 MX-5 Miata. As far as direct rivals go, Mazda's Miata competes in a segment of one. The 2015 Scion FR-S promises excellent driving dynamics, a bit more power and a low starting price, but it is still only available as a hardtop four-seat coupe. The Mini Cooper and Fiat 500 are available as convertibles and they're a bit better equipped than the Miata (and with two more seats), but neither is as much fun to drive. While the hatchback and sedan segments are filled with picks for the shopper seeking a car that's both entertaining and supremely affordable, in the convertible segment, just one model fills the bill. A blast to drive and easy on the wallet, the 2015 Mazda MX-5 Miata is the only choice for the shopper seeking a model that delivers budget-friendly, drop-top driving excitement. No Video Content Body Styles, Trim Levels, and Options The 2015 Mazda MX-5 Miata is a two-seat roadster offered in four trim levels: base Sport, Club, Grand Touring and 25th Anniversary Edition. All come standard with a manually operated soft top as standard. A power-retractable hardtop (PRHT) is available as an option on the Club and Grand Touring models, and comes standard on the 25th Anniversary Edition model. Standard features for the Sport trim include 16-inch alloy wheels, a cloth convertible top with a glass rear window, foglights, air-conditioning, cloth seats, a height-adjustable driver seat, a leather-wrapped tilt-only steering wheel, power windows and mirrors and a six-speaker sound system with a CD player and auxiliary audio jack. The Club trim adds 17-inch wheels, sporty front and rear fascia treatments, black exterior trim, cruise control, power door locks, keyless entry, unique interior trim, a leather-wrapped shift knob, a trip computer and steering-wheel-mounted audio controls. Sport models can be equipped with the Convenience package that includes most of the Club's upgrades (this package is standard in Miata Sport models with the automatic transmission). Further up the ladder, the Grand Touring offers the choice of a black or beige cloth top and adds automatic climate control, leather upholstery, heated seats, an auto-dimming rearview mirror, a seven-speaker Bose audio system with a six-CD changer and silver interior accents. The PRHT models are identically equipped. Club and Grand Touring models can enhance the Miata's already nimble handling with the Suspension package, which includes a sport-tuned suspension with Bilstein shocks and a limited-slip differential (only available with a manual transmission). The Grand Touring qualifies for the Premium package that features keyless ignition and entry, xenon headlights, Bluetooth phone connectivity and satellite radio. The 25th Anniversary Edition Miata is essentially a PRHT Grand Touring model with the contents of Premium and Suspension packages equipped as standard, along with unique 17-inch wheels and upgraded leather upholstery. Powertrains and Performance Powering all 2015 Mazda MX-5 Miatas is a 2.0-liter inline four-cylinder engine that produces 167 horsepower (158 with the automatic transmission) and 140 pound-feet of torque. Sport models come standard with a five-speed manual transmission, while Club, Grand Touring and 25th Anniversary models come with a six-speed manual. All trim levels have the option of a six-speed automatic with shift paddles on the steering wheel, and all Mazda Miatas are rear-wheel drive. In Edmunds testing, a 2015 Miata with a six-speed manual transmission sprinted from a standstill to 60 mph in a reasonably quick 6.8 seconds, and performance is no different with the optional power-retractable hardtop. Fuel economy is about average, with an EPA-estimated 25 mpg combined (22 city/28 highway) for the five-speed manual. The six-speed manual drops slightly to 24 mpg combined (21/28), while the automatic is rated at 23 mpg combined (21/28). Safety Standard safety features on all 2015 Mazda MX-5 Miata models include antilock disc brakes, side airbags and stability and traction control. In Edmunds braking tests, various Miata models turned in stopping distances from 60 mph between 110 and 118 feet, which are respectable numbers for a sports car. Interior Design and Special Features Average-sized drivers will find the 2015 Mazda Miata's cockpit on the snug side, but still very comfortable. Taller drivers will likely run out of legroom, as seat-track travel is limited. The interior itself is rather basic in terms of design and materials, but at least the gauges are very legible and the controls are user-friendly and well-placed. Those who choose the manual convertible top will appreciate its ease of use; all it takes is the push of a button and the tug of a lever to liberate the lightweight top from its moorings. It takes just a few seconds to lower the top, and raising it is just as quick and easy. With practice, some longer- and stronger-limbed drivers can raise the roof without even leaving their seat. With the power-retractable hardtop it takes a bit longer to transform from coupe to roadster, but the added convenience, noise isolation and security make it a good choice if you're using your Miata as a daily driver. With either top down, wind buffeting is impressively low even with the side windows down at 60 mph. Convertibles are notoriously short on trunk space, and the Miata is no exception. With just 5.3 cubic feet of total trunk space available for either hard- or soft top models, there's barely room for a light traveler's luggage and it takes some effort to get golf bags to fit ? if they fit at all. Points are also deducted for the disappointing stereo performance when the top is down. Even the upgraded Bose system suffers from poorly aimed and comparatively weak speakers that fail to fill the cabin with sound. The lack of a USB/iPod interface and unavailability of Bluetooth audio connectivity for either system are additional disappointments. Driving Impressions Overall, the 2015 Mazda MX-5 Miata is one of the best-handling cars you can buy for the money. If you've never owned a rear-wheel-drive car before, it's a great starting point. It's also comfortable and easy to live with whether you're looking to simply put the top down and cruise in the summer sun, or leave the top up and embark on a road trip. The Mazda Miata's calling card, though, is its legendary handling. It can squeeze maximum enjoyment out of any section of winding blacktop, and it owes much of this skill to its communicative steering and well-sorted suspension. Expert drivers might find the car's body roll and stability control intervention to be excessive when pushing hard around corners, but just about everybody else will enjoy its tidy handling. The free-revving four-cylinder engine doesn't pack a whole lot of punch compared to some other sports cars, but it's always eager to play. Additionally, the short-throw shifts and easy clutch action of the manual gearbox are sublime. A significant downside is the engine drone at highway speeds, and your tolerance for it may vary on longer journeys. In addition, the Vehicle may be (a) rebuilt, assembled from parts, or combined; (b) a kit car, glider kit, replica vehicle; (c) a flood vehicle;(d)a not actual mileage vehicle and/or (f) a non-conforming vehicle as that term is defined under Chapter 681 of the Florida Statutes. It is Buyer’s sole obligation to independently verify the Vehicle’s prior use or designation prior to purchase, if these items are material to Buyer. Buyer expressly acknowledges that the Vehicle being purchased under this Order has been involved in a prior accident and that it has sustained damage as a result of such accident. The damage to the Vehicle may include damage that resulted in the Vehicle being deemed a total loss by an insurance company. The Vehicle's status as a total loss vehicle may or may not be reflected on the Vehicle's certificate of title and/or in the Vehicle's title history. Buyer does not rely on any statements from Seller relating to the severity of the accident or nature or quality of the repairs. Seller makes no representations or warranties relating in any way to the quality or nature of such repairs and whether such repairs could affect the safety or reliability of the Vehicle. Buyer's opportunity to inspect or to have the Vehicle inspected, as outlined above is specifically designed to allow Buyer to fully and completely assess the Vehicle prior to purchase. The purchase price for the Vehicle has been negotiated by the parties by taking into consideration the prior accident damage and the current condition of the Vehicle Seller makes no warranties, representation or assurances that the motor vehicle contains only original manufacturer installed or manufacturer rebuilt components, parts or accessories. In addition to other warranties made in this Order, Buyer expressly warrants the following: (a) To the extent that Buyer seeks financing for the Vehicle, Buyer warrants that all information contained on any credit application or other document submitted to Seller in order to obtain financing is true and accurate. Buyer acknowledges that the price of the vehicle is not effected by Buyer’s decision to finance the Vehicle or based upon the financial institution through which Buyer elects to finance the Vehicle. (b) To the extent that Buyer is trading in a vehicle (hereinafter “Trade”) as part of this transaction, Buyer agrees to provide satisfactory title to such Trade. Buyer warrants that the Trade is free and clear of all liens and encumbrances, other than those disclosed above. Buyer warrants that Buyer is the sole owner of the Trade and that Buyer has the right to assign title to the Trade to Seller. Buyer warrants that the Trade is in good operating condition and that it has not suffered accident or collision damage of which Buyer is aware. (c) Buyer warrants that Buyer has and will maintain full liability and comprehensive insurance coverage on the Vehicle.(d) Buyer warrants that this Order and any accompanying finance documents are complete and accurate at the time the Buyer signed them. (e) Buyer warrants that Buyer is over the age of 18, of sound mind, not under the influence of any drugs or alcohol and is otherwise competent to enter into this transaction. In addition to all other rights and remedies available to Seller at law or in equity, Seller has the following rights and remedies under this Order: (a) Reclamation. – Seller may enter into Buyer’s property and reclaim the Vehicle with or without notification to Buyer. Seller may also make a written demand on Seller to return the Vehicle and Buyer agrees to do so within 24 hours of such demand. (b) Disposition of Trade – Buyer agrees that immediately upon Buyer’s execution of this Order, Seller may dispose of Buyer’s Trade in any commercially reasonable manner, including the sale of the Trade to a third party, retail or wholesale. In the event that this Order is not completed for any reason or in the event that it is rescinded for any reason, Seller agrees that Buyer may retain the proceeds of the sale of the Trade to offset its damages, if any. If Seller does not have any damages relating to rescission or failure of this Order to be completed, Seller may retain any costs and reconditioning expenses relating to the sale plus a 15% commission on the sale from the sale proceeds. The remaining amount shall be delivered to Buyer in full satisfaction of any claims relating to the Trade. (c) In the event that Buyer pursues any claim for rescission of this transaction, Seller shall have the right to set off against Buyer’s damages or to assert as an independent claim, a claim for the reasonable value of Buyer’s use of the vehicle, including depreciation and mileage of the Vehicle. If any term of this Order is held to be unconscionable or unenforceable, for any reason, by any court of competent jurisdiction, this Order shall be construed as if such clause were never a part of this Order and the balance of the terms of this Order shall be binding on the parties. The waiver or invalidity of any provision of this Order shall not effect the binding nature of the remaining provisions. No breach of this Order by Buyer shall be deemed waived unless such waiver is agreed to by Seller in writing. The parties agree that any modification of this Order must be made in writing and signed by the parties in order to be valid. Buyer agrees that if the Vehicle is to be shipped, that shipping is Buyer’s responsibility. To the extent that Seller assists Buyer in arranging for shipping, such arrangements are made as a courtesy to Buyer and do not create any liability or responsibility on the part of Seller. Buyer agrees that all risk of loss transfers to Buyer upon delivery of the Vehicle to Buyer’s carrier and Buyer appoints such carrier as Buyer’s agent for purposes of accepting delivery of the Vehicle. Buyer agrees that Buyer’s deposit /down payment on the Vehicle is non-refundable, unless otherwise agreed to in writing by Buyer and Seller. Buyer agrees that the Vehicle has been delivered to Buyer and Buyer accepts delivery of the Vehicle in Florida, at Seller’s principle place of business. If Buyer is shipping the Vehicle out of state, then the person accepting delivery of the Vehicle for Buyer shall be deemed Buyer’s agent for accepting delivery of the Vehicle in Florida. This Order and the entire transaction between the parties shall be governed by Florida law. This Order supersedes any and all prior and contemporaneous verbal or written agreements, representations and/or understandings between Buyer and Seller. The terms, representations and conditions set forth in this Order, and any applicable financing agreement, constitute the entire agreement of the parties. The parties to this Arbitration Agreement hereby agree that any and all Claims (defined below) shall be decided through binding arbitration as provided for herein. For purposes of this Arbitration Agreement: Us/Our means Diamond Financial Enterprise, Inc. d/b/a USA CARS and/or "Seller" (as identified in any accompanying Retail Installment Sales Contract), as well as their individual and/or collective parents, subsidiaries, affiliates, predecessors and successors in interest, and agents, and all of their officers, directors and employees. Us/Our also includes any assignee or holder of the Retail Installment Sales Contract, any finance company that extends credit to You as part of the Transaction or that acquires any interest in the Retail Installment Sales Contract after you execute it, as well as any third party alleged to be Our agent or to be acting on Our behalf. You/Your means the customer signing this agreement as well as anyone acquiring any interest in the vehicle that is part of this Transaction. Transaction means your purchase and/or financing of the vehicle from Us. Arbitration Agreement means this Arbitration Agreement Claim means any claim, dispute or controversy between you and us arising from or related to: 1) the Transaction; 2) any negotiations, disclosures and/or representations relating in any way to the Transaction, including, but not limited to any issues relating to the advertising of the vehicle or representations made prior to the Transaction; 3) the vehicle acquired as part of the Transaction, including its condition, prior use or status; 4) Our efforts to collect any amounts due under the contract or as part of the Transaction; 5) Our recovery or attempted recovery of the vehicle; 6) the extension of any credit to You; 7) the terms and conditions of any Retail Installment Sales Contract or finance agreement relating to the vehicle; and 7) the validity, enforceability or scope of this Arbitration Agreement. For purposes of this Arbitration Agreement Claim has the broadest possible meaning. It includes claims of every kind and nature regardless of who initiates it. This Arbitration Agreement requires that all Claims be arbitrated before an arbitrator instead of litigated in court with a Judge and/or a jury. The Claim shall be arbitrated on an individual basis and not as a class action. This Agreement applies to all Claims, even Claims that existed before you sign it. All Claims shall be resolved by arbitration in accordance with this Agreement. Either party may demand that a Claim be arbitrated and enforce the rights under this Agreement by obtaining a court order requiring that a Claim be decided through binding arbitration. In any arbitration under this Agreement, a single arbitrator shall decide the dispute. The arbitrator shall be a retired judge or an attorney that has been practicing law in Florida for at least 15 years. If the parties are not able to agree upon an arbitrator, then either party may request that a court of competent jurisdiction appoint an arbitrator in accordance with the provisions of Florida's Arbitration Code. If there is to be an in person arbitration hearing, it shall take place in Pinellas County, Florida. The party initiating the arbitration shall pay any filing fee required to institute such a proceeding. Thereafter, each party shall be responsible for half of the fees and expenses related to the arbitration. If one party cannot afford the arbitration fees, the other party may elect to pay the full amount of the arbitration fees and expenses. The arbitrator shall have the right to award arbitration costs if applicable law allows for such an award. Each party shall pay its own attorneys’, experts' and witness fees, regardless of who prevails in the arbitration, unless the law gives a party the right to recover any of those fees from the other party. If the law allows for an award of such fees, then the arbitrator may award them as permitted by such law. The Federal Arbitration Act (“FAA”) governs this Agreement, except for the provisions dealing with the appointment of an arbitrator which shall be completed in accordance with Florida's Arbitration Code. In rendering any decision relating to a Claim, the arbitrator shall apply all applicable substantive laws, including statutes of limitation. Miscellaneous. This Agreement survives payment of all You owe under any related Retail Installment Sales Contract or financing agreement and this Agreement remains binding upon the You and US even if the Retial Installment Sales Contract or financing agreement is assigned to a third party. It also survives your bankruptcy. If a court or arbitrator deems any part of this Arbitration Agreement invalid or unenforceable for any reason, the invalid or unenforceable provision shall drop out of the Arbitration Agreement and the remaining parts of this Arbitration Agreement shall be enforceable despite such invalidity.
