But oftentimes these vehicles can be rather plain and anonymous. If you desire a crossover with style and presence that is still quite family-friendly, the 2013 Volvo XC60 is one of our top picks. This year the XC60 receives its first major update since its debut back in 2010. Visually, it looks sleeker thanks to a new front end design. Inside, you'll find new instruments, added metallic accents and white, rather than green, button illumination. Body Styles, Trim Levels, and Options The 2013 Volvo XC60 is a luxury SUV that seats five people. It is available in 3.2, T6 and T6 R-Design trim levels. Safety Every 2013 XC60 comes standard with antilock brakes, traction and stability control, front side airbags, side curtain airbags and whiplash-preventing front seats. Also standard is City Safety, which can mitigate or avoid a low-speed frontal impact by applying the vehicle's brakes without driver intervention. Included in the optional Technology package is an upgraded pedestrian detection feature, which can apply full braking force (reducing speed by as much as 22 mph) to help you avoid hitting pedestrians and cyclists who are at least 31 inches in height. This package also includes electronic warnings for driver inattention, lane departure and impending collision, the last of which includes automatic braking. Introduction Among compact to midsize luxury crossover SUVs, the 2014 BMW X3 stands apart from most rivals. With its superb driving dynamics, spacious and upscale interior accommodations, and solid fuel economy ratings, the X3 is a front runner in this class and definitely one you'll want to check out, particularly if you have a family. BMWs are typically known for providing an engaging experience behind the wheel, and that trait certainly holds up for the X3. While it's not quite as sporty as its smaller sibling, the X1, the X3 still provides much more feedback and entertainment through turns than the average luxury SUV. A lot of that fun also comes from what's under the hood. BMW offers two engine choices, both turbocharged: a 2.0-liter four-cylinder (xDrive 28i) and a 3.0-liter inline-6 (xDrive 35i). If you're unsure about the idea of a four-cylinder luxury SUV, the X3 will make you a believer: The xDrive28i version offers plenty of power plus the bonus of great fuel economy. Going with the larger engine in the BMW X3 xDrive35i does drop fuel economy a little, but in return you get one of the quickest models in this class. Inside the 2014 BMW X3, you get more of what BMW is known for: impressive quality. We've found that the X3's front seats provide great support for both long road trips and enthusiastic drives on back roads. Materials quality is first class, with understated wooden trim, brushed-metal accents and a general refinement that elevates the cabin ambience. The X3 also lives up to expectations for utility, as its rear seat is roomy and cargo space is competitive. Other compact luxury crossovers, such as the Audi Q5 and Mercedes-Benz GLK350 are down on interior room, but they're just as luxurious and stylish, and potentially a bit more fuel-efficient, thanks to available diesel and hybrid variants. The X3 tends to be pricey, too, and it's worth looking at less expensive crossovers such as the Acura RDX or Volvo XC60 if you have a keen eye on the budget. Overall, though, the 2014 BMW X3's wealth of strengths make it a top recommendation for this class. No Video Content Body Styles, Trim Levels, and Options The 2014 BMW X3 crossover SUV is available in two trim levels that correspond to engine choice: xDrive28i and xDrive35i. The xDrive28i model comes standard with 18-inch wheels; rear privacy glass; automatic headlights; foglamps; automatic wipers; a power liftgate; auto-dimming mirrors; cruise control; dual-zone automatic climate control; eight-way power front seats with memory functions; leatherette premium vinyl upholstery; a tilt-and-telescoping steering wheel; Bluetooth phone connectivity; the iDrive electronics interface; and a 12-speaker sound system with a CD player, HD radio, an iPod/USB audio interface and an auxiliary audio input. Besides its more powerful engine, the xDrive35i adds adaptive bi-xenon headlights, a panoramic sunroof and wood trim. These items are options on the xDrive28i. The Premium package includes the panoramic sunroof (xDrive28i), keyless ignition/entry, leather upholstery, four-way lumbar support for the front seats, satellite radio, cargo area nets and tie-down points. The Cold Weather package includes heated front seats, a heated steering wheel and heated rear seats. The Technology package gets you a head-up display, a navigation system with a larger main iDrive display, smartphone app integration and the BMW Remote Services emergency communications system. The Driver Assistance package adds front and rear parking sensors and a rearview camera. On top of this you can add the Driver Assistance Plus package, which has rear- and top-view parking cameras and a lane-departure warning system. Powertrains and Performance The 2014 BMW X3 xDrive28i is powered by a 2.0-liter turbocharged four-cylinder engine that produces 240 horsepower and 260 pound-feet of torque. An eight-speed automatic and all-wheel drive are standard on all BMW X3s, along with an automatic stop-start system. The latter shuts off the engine when stopped and then starts it when you take your foot off the brake in order to save fuel. In Edmunds performance testing, the four-cylinder X3 went from zero to 60 mph in 6.8 seconds, which is average overall for the segment and as quick as some six-cylinder crossovers. EPA-estimated fuel economy stands at 21 mpg city/28 mpg highway and 24 mpg combined. The X3 xDrive35i gets a 3.0-liter turbocharged inline-6 that produces 300 hp and 300 lb-ft of torque. It uses the same eight-speed automatic, and AWD is standard. In Edmunds performance testing, the 35i hit 60 mph in 5.6 seconds, which makes it one of the quickest vehicles in this segment. Fuel economy is rated at 19/26/21, which is actually better than some of the X3 xDrive35i's less powerful rivals. Safety Every 2014 BMW X3 comes standard with antilock disc brakes, automatic brake drying (useful in rainy weather), front seat side airbags, full-length side curtain airbags, active front seat head restraints, stability control and hill descent control. Also standard is the BMW Assist emergency communications system, which provides automatic crash notification and on-demand roadside assistance. The optional BMW Remote Services system upgrades BMW Assist with stolen-vehicle recovery and remote door unlocking. Other optional equipment includes front and rear parking sensors, rear- and top-view parking cameras and a lane-departure warning system. In Edmunds brake testing, an xDrive35i stopped from 60 mph in 123 feet, which is an average distance for the segment. An xDrive28i with the M Sport package stopped in 127 feet. In crash testing by the Insurance Institute for Highway Safety, the X3 received the highest possible rating of "Good" in the frontal-offset, side-impact and roof strength tests. Interior Design and Special Features The X3's interior will be familiar to anyone who has spent time in a BMW product. Classic analog gauges, sensible ergonomics and a restrained overall aesthetic combine to create a pleasant driving environment. Occupants will feel cocooned within the high-quality materials covering the seats, console and dash. Overall, we're fond of the iDrive electronics interface, particularly with the higher-resolution screen that comes with the navigation system. The menu structure is straightforward, the graphics are crisp and processing times are quick, which helps minimize the amount of time you spend looking away from the road. That said, new owners should sit down and familiarize themselves with iDrive before hitting the road, because it's still a complex system and you can't master everything while the car's in motion. Room for front passengers is more than ample, while rear legroom is downright generous and pairs with a truly comfortable seat. Indeed, this is one of the most family-friendly vehicles in the class. Total cargo capacity with the rear seats folded is 63.3 cubic feet, which makes it one of the larger compact luxury crossovers. Driving Impressions Don't dismiss the 2014 BMW X3 xDrive28i based on its four-cylinder power plant. Acceleration is very quick, and it's one of the most fuel-efficient models in the crossover segment based on EPA estimates. The auto stop-start function that comes with this engine can be an annoyance in heavy traffic, because the engine doesn't restart as quickly or smoothly as we'd like when transitioning between the brake pedal and the gas (fortunately, you can manually disable this feature). If your budget allows, though, the X3 xDrive35i will be hard to pass up, as its acceleration is very impressive, while fuel economy is still quite good in normal driving. The X3 delivers on the promise of BMW performance in other respects, too. Take it around a turn with enthusiasm, and it feels light and nimble. As small luxury crossovers go, it's one of the sportiest, particularly with its optional suspension and drivetrain add-ons. Notably, 2.5i Premium models now have standard heated seats, while the base 3.6R trim level has been discontinued. Introduction For many years, shoppers wanting a wagon with some outdoor capability have turned to the Subaru Outback. Since its introduction almost 20 years ago, it has been the great SUV alternative. Outbacks are known for their cargo space and dexterity in the dirt, but they've always been held in equal regard for their excellent manners on paved roads. The 2014 Subaru Outback is much larger than the original Outback and competes directly with midsize crossovers aimed at families. Although it might not hold the same appeal for the granola crowd as its smaller predecessors did, this Subaru is still a strong choice for anyone who craves a little adventure. Since every Subaru Outback comes standard with all-wheel drive and boasts a generous 8.7 inches of ground clearance, it's one of the most capable crossovers off-road. You won't be able to follow a caravan of Jeeps up the Rubicon Trail, but dirt trails, snowy mountain passes or muddy country roads won't stop this Subaru wagon. Equally important, the Outback has an impressive 71 cubic feet of maximum cargo capacity for your camping and outdoor sports gear. And when you opt for the four-cylinder engine, this crossover wagon is capable of hitting 30 mpg on the highway. If you're looking to tow a small trailer, the available six-cylinder engine enables the Outback to pull up to 3,000 pounds. Also standard is a roof rack with built-in cross rails that conveniently fold out of the way when you're not using them. There aren't too many options if you're looking for a midsize wagon or crossover with some off-road capability. The Toyota Venza is a bit more carlike behind the wheel and has less cabin noise and nicer interior materials, but it won't go all the places the Outback can. On the higher end, the Audi Allroad and Volvo XC70 share the Outback's rugged aesthetic (and some of its capability), but they cost significantly more. Another option is a true SUV like the 2014 Jeep Grand Cherokee, which offers even more off-highway capability, though it, too, tends to cost more. Of course, you could also look at mainstream crossovers like the Honda CR-V and Mazda CX-5, which offer similar interior room but aren't really hardy enough to go too far off the beaten path. Ultimately, the 2014 Subaru Outback is a pretty unique vehicle and if you have an adventurous spirit, we recommend it highly. No Video Content Body Styles, Trim Levels, and Options The 2014 Subaru Outback is a five-passenger wagon offered in four trim levels: 2.5i, 2.5i Premium, 2.5i Limited and 3.6R Limited. The numbers refer to engine displacement. The base 2.5i comes with 16-inch steel wheels; roof rack rails with fold-out crossbars; full power accessories; cruise control; air-conditioning; a height-adjustable driver seat; a tilt-and-telescoping steering wheel; 60/40-split-folding and reclining rear seats; Bluetooth phone and audio connectivity; and a four-speaker sound system with a CD player, an iPod/USB audio interface and an auxiliary audio jack. An option package allows you to upgrade the base Outback (CVT models only) with 17-inch alloy wheels and foglights. The 2.5i Premium model has all the base car's equipment, along with 17-inch wheels, foglights, rear privacy glass, heated mirrors, a windshield wiper de-icer, an eight-way power driver seat (with power lumbar), a leather-wrapped steering wheel, heated front seats, a cargo cover and a six-speaker sound system with satellite radio. If your 2.5i Premium has the continuously variable transmission (CVT), you can opt for the Power Moonroof package, which adds a sunroof, an auto-dimming rearview mirror and a rearview camera. Available as part of an upgraded Power Moonroof package is Subaru's EyeSight driver assist system, which includes adaptive cruise control, a lane departure warning system and a collision warning/mitigation system with brake intervention. Also available is a package that combines the moonroof with a navigation system that features a 7.0-inch touchscreen display, smartphone app integration and a rearview camera. Stepping up to the 2.5i Limited adds dual-zone automatic climate control, leather upholstery, wood trim, a four-way power passenger seat, an upgraded gauge cluster and a nine-speaker Harman Kardon sound system with HD radio. Options for the Limited are similar to the 2.5i Premium, but now the EyeSight system can be purchased in combination with the navigation system. In addition, there's a Special Appearance package that bundles the moonroof, EyeSight and nav system with unique exterior styling details, keyless ignition/entry, driver seat memory functions and perforated leather upholstery. The 3.6R Limited comes with a six-cylinder engine, but otherwise its standard and optional equipment is identical to that of the 2.5i Limited. Powertrains and Performance The all-wheel-drive Subaru Outback is offered with two different engines. The 2.5i models use a 2.5-liter horizontally opposed ("boxer") four-cylinder that produces 173 horsepower and 174 pound-feet of torque. It comes paired with either a six-speed manual transmission or a CVT. The CVT provides the functionality of an automatic transmission. EPA fuel economy estimates for the four-cylinder with the CVT are 24 mpg city/30 mpg highway and 26 mpg combined. Models with the six-speed manual return 22/29/24. Both results are pretty good for an all-wheel-drive four-cylinder crossover. The 2014 Outback 3.6R Limited comes with a 3.6-liter horizontally opposed six-cylinder engine good for 256 hp and 247 lb-ft of torque. A five-speed automatic with shift paddles is the only transmission offered. In Edmunds performance testing, the 3.6R accelerated from zero to 60 mph in 7.3 seconds, a strong time for a six-cylinder-powered crossover or wagon. However, EPA fuel economy is below average at 17/25/20. Safety Every 2014 Subaru Outback comes standard with four-wheel antilock disc brakes, stability and traction control, front seat side airbags and side curtain airbags that cover both rows. A rearview camera is available starting on CVT-equipped Premium and Limited models. Subaru's optional EyeSight system includes adaptive cruise control, pre-collision braking and lane departure warning functionality (it will also warn you if you're swaying within your lane during highway travel). The EyeSight system uses two cameras mounted inside the upper edge of the windshield, which Subaru says reduces the potential for damage compared to conventional radar systems mounted in the front bumper. EyeSight can also detect pedestrians and is capable of braking the Outback if the driver takes no evasive action. In Edmunds brake testing, the 3.6R came to a stop from 60 mph in 126 feet, a bit longer than average for this type of vehicle. In government crash tests, the Subaru Outback earned a five-star overall rating, along with five-star ratings for its performance in front- and side-impact crash protection. In the Insurance Institute for Highway Safety's testing, the Outback received the highest Top Safety Pick+ accolade after earning a Good rating (the highest possible) in the moderate-overlap front-offset crash test, as well as the side-impact and roof strength tests. It also earned an Acceptable rating (second highest) in the new small-overlap frontal-offset crash test. Interior Design and Special Features With its redesign a few years ago, the Subaru Outback traded its traditionally smaller footprint for more family-friendly dimensions. That extra room is immediately evident when you get inside, where even rear seat passengers now enjoy excellent headroom and legroom. The rear seatbacks also recline for greater comfort. Behind those rear seats you'll find 34.3 cubic feet of cargo space. Folding them down yields 71.3 cubic feet, which is on par with the Venza and CR-V. For anything that doesn't fit inside, the Outback features built-in roof rack cross rails that swing inward when needed to attach bikes, snowboards and kayaks. Loading up recreational gear is also made easier by the Outback's reasonable overall height, as it's shorter than most other crossover SUVs. Practical as it is, the 2014 Subaru Outback's cabin has a lot of hard plastic, which is tolerable on base models but feels a bit too down-market once you get to the Limited trim level. Most buyers will find it worth the leap to the 2.5i Premium trim level, as the base 2.5i model's standard four-speaker stereo sounds tinny and flat. The touchscreen interface in navigation-equipped Outbacks can be frustrating at times, as the menus are complicated and the on-screen buttons are not always responsive to touch. Driving Impressions The Outback's last growth spurt opened up plenty of interior room, but it lost the previous generation's quick handling in the process. On the other hand, the current Outback has a very forgiving ride that makes it a natural for road trips. Subaru says it stiffened the wagon's structure and retuned the suspension to reduce body roll and improve handling for 2013. We have yet to test an Outback that incorporates these changes, but when we do, we'll update this review. Meanwhile, the 2014 Subaru Outback's standard all-wheel drive and 8.7 inches of ground clearance make it a natural for light off-roading. Of course, the Subaru is not meant to keep up with rock-crawling Jeeps, but ferrying kayaks and mountain bikes to campsites and trailheads is a cinch. The 2.5-liter four-cylinder engine delivers adequate performance and respectable fuel economy with either the six-speed manual or the CVT. It's a good choice if your primary concern is fuel economy. But if you live in the mountains or frequently haul full loads of passengers or cargo in your Outback, you'll be better served by the six-cylinder. Introduction More than 50 years have passed since Lincoln represented the luxury motoring experience to which many Americans aspired. Time has not favored the brand, and import-brand cars are no longer the alternatives, but rather the standard bearers of luxury car ownership. Competition is especially intense in the popular entry-level luxury sedan class, where the 2014 Lincoln MKZ looks to reclaim some of that former Detroit glory. It starts with a sleek, modern look highlighted by a split-winged grille, followed by creased sheet metal that wraps tightly around the MKZ's four doors, and finishing with a full-width LED taillight panel. The MKZ is heavily related to the Ford Fusion, but at least on the outside, there's plenty of differentiation between the two cars. Underneath, you'll find one of three available engines: a turbocharged four-cylinder, an optional V6 (which isn't offered on the Fusion, incidentally) and a hybrid powertrain in the MKZ Hybrid. We haven't been particularly impressed with the V6's acceleration and fuel economy. The base turbo four-cylinder is a respectable performer, though, while the Hybrid delivers an estimated 38 mpg in combined driving. The MKZ also rides like a traditional Lincoln. It's quiet and unfazed by the road's imperfections, thanks largely to a standard adaptive suspension and active noise cancelling inside the cabin. When the road turns twisty, however, the MKZ dispenses with tradition and holds the road tighter than any Lincoln in recent memory. Overall, the 2014 Lincoln MKZ is a competent sedan. But it takes more than competence to win in this class. The Lexus ES 350 and ES 300h hybrid, for example, have more luxurious interiors. The 2014 Acura TL and Volvo S60 deliver stronger six-cylinder power along with available all-wheel drive. And for all-around sporting character and refinement, the 2014 Audi A4 and BMW 3 Series remain the ones to beat. Although the MKZ represents a significant step forward for the brand that once set the standard, there's still more work to be done. No Video Content Body Styles, Trim Levels, and Options The Lincoln MKZ is a midsize luxury sedan that comes in two trim levels: MKZ and MKZ Hybrid. Both come with 18-inch wheels, adaptive LED headlights, LED taillights, adaptive suspension dampers, keyless ignition/entry (with an outside keypad), dual-zone automatic climate control, leather upholstery, heated 10-way power front seats with power lumbar, driver memory settings, a tilt-and-telescoping steering wheel, cruise control, an auto-dimming rearview mirror and full power accessories. Also standard are the Sync voice command system, the MyLincoln Touch infotainment system with an 8-inch touchscreen interface, and an 11-speaker sound system with CD player, auxiliary/USB/iPod input jacks and satellite radio. Most options are grouped into tiered packages, starting with the Select package that includes front bumper accent lights, an auto-dimming driver-side mirror, a rearview camera, rear parking sensors, wood steering wheel trim, ambient lighting and HD radio. The Reserve package includes those features plus a navigation system, a blind spot monitoring system with rear cross-traffic alert, a power-close trunk lid, a power tilt-and-telescoping steering wheel and ventilated front seats. Finally, the Preferred Equipment package groups all the optional features above and adds 19-inch wheels, a heated steering wheel, heated rear seats, a 110-volt power outlet and a premium 14-speaker surround-sound audio system. An available Technology package bundles adaptive cruise control, an automated parallel parking system, a lane departure/keeping system, collision warning/mitigation, automatic headlights and automatic windshield wipers. There's also a Summer Tire Handling package (AWD, non-hybrid only) that includes 19-inch wheels, summer tires and a sport-tuned suspension and steering rack. Individual option highlights include a standard sunroof, a panoramic glass roof with integral sunroof, multicontour front seats, a power rear sunshade and airbag-embedded rear seatbelts. Powertrains and Performance The 2014 Lincoln MKZ offers three engine choices. A 2.0-liter turbocharged four-cylinder is the base engine, generating 240 horsepower and 270 pound-feet of torque through a six-speed automatic transmission with paddle shifters. Front-wheel drive is standard, and all-wheel drive is optional. In Edmunds testing, an all-wheel-drive MKZ with the 2.0 turbo accelerated from zero to 60 mph in 7.2 seconds, an average time for the class. The front-drive MKZ returns an EPA-estimated 26 mpg combined (22 city/33 highway); AWD models rate 25 combined (22 city/31 highway). The optional 3.7-liter V6 produces 300 hp and 277 lb-ft of torque, also through a six-speed automatic and either front- or all-wheel drive. In Edmunds testing, a V6-powered all-wheel-drive MKZ covered zero to 60 mph in 6.7 seconds, a below-average result for six-cylinder entry-luxury sedans. Front-drive V6 models return an EPA-estimated 22 combined (19 city/28 highway), while all-wheel-drive models achieve 21 combined (18 city/26 highway). Finally, the 2014 Lincoln MKZ Hybrid combines a 2.0-liter four-cylinder with an electric motor for 188 total hp. The hybrid is front-wheel-drive only and uses a continuously variable transmission (CVT) to return 38 mpg combined (38/37). We haven't yet tested an MKZ Hybrid, but the mechanically similar Ford Fusion Hybrid accelerated from zero to 60 mph in 8.4 seconds -- not a record-breaking performance, but on the quicker end of hybrid sedan performance and on par with the Lexus ES 300h. Safety Standard safety features include antilock disc brakes, stability and traction control, front side-impact airbags, front knee airbags and side curtain airbags. The 2014 Lincoln MKZ also features the programmable MyKey system, allowing parents to set limits for vehicle speed and stereo volume for their young drivers. Sync also offers emergency crash notification that automatically dials 911 in the event of an airbag deployment. Optional equipment includes a rearview camera, blind-spot monitoring, rear cross-traffic alerts, lane-departure warning and lane keeping assist (which automatically helps the driver keep the car in its lane) systems, a forward collision warning system with brake support, and airbag-embedded rear seatbelts. In Edmunds brake testing, an MKZ with standard all-season tires stopped from 60 mph in 121 feet, an average distance for this segment. In government crash testing, the MKZ earned the maximum five-star rating for overall crash safety, five stars for total frontal-impact protection and four stars for total side-impact protection. In Insurance Institute for Highway Safety (IIHS) tests, the MKZ earned a top score of "Good" in moderate-overlap frontal-offset, side-impact and roof strength tests. The IIHS also gave the MKZ a second-best score of "Acceptable" for its new small-overlap frontal offset test. Interior Design and Special Features Inside, the 2014 MKZ's flowing center stack and console, devoid of buttons and knobs, feels like a futuristic template for how all car cabins might evolve. While the design looks forward, the materials are decidedly economy-class. Bumpy, utility-grade material covers the dash, door panels and console, and the brushed metal accents are nice from afar but exposed as garden-variety plastic on closer inspection. Even the gear selector buttons (no stalk shifter here) feel flimsy, without any damped, tactile sensation to confirm the state of the transmission. Although related to the roomy Fusion sedan, the MKZ's styling distinctions actually yield less interior space. The high center console can make the front seating area feel a little confining, while the coupelike roof line infringes on the headroom of taller rear seat passengers. Rear-seat legroom, however, is generous. The MyLincoln Touch infotainment system remains problematic. Each new software update improves it slightly, but the touchscreen interface is plagued by small virtual "buttons," slow response times and not-infrequent crashing. That said, the system offers a clean layout and splits functions into four clear quadrants: navigation, audio, climate and phone. And there's still the Sync voice command system that can control many of the tactile functions, but that's little consolation for those who prefer to not talk to their car. The MKZ offers decent trunk space at 15.4 cubic feet, although the hybrid's capacity shrinks to 11.1 cubic feet due to the battery pack. Non-hybrids also feature a 60/40 split-folding rear seat. Driving Impressions Equipped with the standard 18-inch all-season tires, the 2014 Lincoln MKZ offers a quiet, compliant ride -- exactly what you expect from this class, and more particularly, from Lincoln. However, we've also tested an MKZ with 19-inch wheels and summer tires (a rarely equipped option on this car), and it had a stiff, noisy ride. Our advice is to stick with the all-season tires. The MKZ's biggest surprise comes in its ability in the curves. The standard adjustable suspension and quick electrically assisted steering make the MKZ feel more alert than any other Lincoln in recent memory. The MKZ isn't quite up to the standards of the traditional German benchmarks, but most consumers will find it competent and enjoyable in this regard. All-wheel-drive models don't offer a dynamic advantage on dry roads, but are worth considering in areas that get significant snowfall. Although the V6 offers more power, we've found the turbocharged four-cylinder equal in almost every other way. It's lighter and offers sharp throttle response. Acceleration to 60 mph is just a half-second slower than the V6 version, yet it offers better fuel economy. The 2014 Lincoln MKZ Hybrid is generally as pleasant to drive as its gasoline counterparts. The hybrid rides smoothly and acceleration is adequate around town. There's generally enough passing power on the highway, too, especially if you plan ahead. The hybrid model's regenerative braking takes some getting used to, though, and inching forward or backward into a parking stall takes a delicate touch on the brake pedal. The waiver or invalidity of any provision of this Order shall not effect the binding nature of the remaining provisions. No breach of this Order by Buyer shall be deemed waived unless such waiver is agreed to by Seller in writing. The parties agree that any modification of this Order must be made in writing and signed by the parties in order to be valid. Buyer agrees that Buyer's deposit on the Vehicle is non-refundable, unless otherwise agreed to in writing by Buyer and Seller.In addition to any other breaches of this Order, the following expressly constitute acts of default under this Order: (a) The refusal of any financial institution to finance any portion of the purchase price; (b) The failure of Buyer to make any payment required under any accompanying finance agreement; (c) The failure of Buyer to provide Seller with a lien free title to any Trade or the failure of Buyer to pay Seller any amount in excess of the payoff on the Trade after demand from Seller; (d) Any misstatement or misrepresentation by Buyer, whether intentional or not, on any document submitted to Seller in connection with this transaction. (e) The refusal of any financial institution to honor any check, draft or other instrument presented by Seller in connection with the acquisition of the Vehicle.
